BridgeCard Terms of Use

By accessing Bridgecard, you confirm that you are in agreement with and bound by the terms contained in the Terms of Use (“Terms of Use”) outlined below. These terms apply to the provision of usage of our credit card and other financial services (“Services”) by Bridgecard Limited (“Bridgecard”, “Company” “we”, “our”) via our App and our websites (“Service Site”) and your access to the Services.
1. License
1.1 Bridgecard grants you a revocable, non-exclusive, non-transferable, limited license to use the App, Service Sites, and other platforms, as may be applicable, strictly in accordance with these Terms of Use, which are binding on you, and which forms the basis of our relationship with you.
1.2 You are required to signify your assent to these Terms of Use. You also agree that your violation of any provisions of these Terms of Use, is sufficient grounds for the Company to exercise its right to cancel your account or block access to your account with or without notice, as may be necessary.
1.3 You agree that you will not aid, abet, procure or permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App or Service Site to any third party; modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App or the Service Site; remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of the Company or its affiliates, partners, or the Licensor of the App ;and merchandise, or unlawfully or illegitimately appropriate the App for your use, against the interest of Bridgecard.

2. In-App Cookies and Third-Party Links
2.1 Cookies
2.1.1 The Company use Cookies to log your activities in the App and on the Service Site for the purpose of improving your user experience. The Company also use Cookies to enhance the performance and functionality of the App and our Service Site even though they are non-essential to their use. But, without these cookies, certain functionalities may become unavailable or you would be required to enter your login details every time you visit the App or our Service Site as we would not be able to remember that you had logged in previously.
2.1.2 Bridgecard will not place your Personally Identifiable Information in Cookies. Also, we use cookies, web beacons, flash cookies, HTML 5 cookies, pixel tags and other web application software methods, including mobile application identifiers, to help us recognize you across our Services, learn about your interests both on and off our Services, improve your experience, increase security, measure use and effectiveness of our Services, and serve advertising. You can control Cookies through your browser or app settings and other tools. By interacting with our App or Service Site, you consent to the use and placement of Cookies on your device.
2.1.3 The Company uses essential, non-essential, and preference Cookies on its Service Site and in the App, and may add other kinds of cookies from time to time. You agree that your continued access or use of the App or Service Site even after a clear Cookies opt-in pop up message appears in the user interface suffices as consent to the use of cookies.
2.1.4 We may also partner with selected third-party vendors such as Amplitude, Google Analytics and others to allow tracking technologies and remarketing services in the App through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the App, determine the popularity of certain content and better understand online activity. By accessing the App or Service Site, you consent to the collection and use of your personal data by these thirdparty vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer your personal data to these third-party vendors. However, if you do not want your personal data to be collected and used by tracking technologies, you can visit the third-party vendor or the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool. Please note that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.
2.1.5 Your IP address is automatically assigned to your device by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses our systems, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other systems. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the systems. We may also derive your approximate location from your IP address.
2.2 Links to Other Websites
2.2.1 This Terms of Use applies only to the Services. The Services may contain links to other websites or apps or other third-party services which are not operated or controlled by Bridgecard. Bridgecard is not responsible for the content, copyright compliance, accuracy or opinions expressed in such websites or apps.
2.2.2 You also agree that when you use a link to go from the App or Service Site to another website or app, this Terms of Use are no longer applicable. Any activity you undertake on that other website and app including browsing will be governed by that other website’s or app’s terms of use. This is notwithstanding the fact that such a website or app has a link on the App

3.Cessation of the Services, modifications and Amendments to the Terms of Use
3.1 Cessation
3.1.1 By using the App or Service Site, you acknowledge and agree that Bridgecard may stop (permanently or temporarily) providing the Service (or any features within the App) to you or to users generally at sole discretion of Bridgecard And you also agree that for technical, unforeseeable or other reasons, such cessation of the Services may be without prior notice to you.
3.1.2 You may stop using the App or Service Site at any time, and you do not need to specifically give notice to Bridgecard when you stop using the App or Service Site. Also, you acknowledge and agree that Bridgecard may disable access to your account due to lack of use for an extended period.
3.1.3 Without prejudice to your right to request for your data as a data subject, you may be prevented from accessing the Service, your account details or any files or other materials which is contained in your account.
3.2 Updates and Modifications to the App
3.2.1 Bridgecard may, as may be necessary from time to time, provide enhancements or improvements to the features/functionality of the App or the Service Site, which may include patches, bug fixes, updates, upgrades and other modifications. However, Bridgecard is not bound to (a) provide any updates, and (b) continue to enable any feature or functionality you may prefer.
3.2.2 You agree that all updates will be deemed to constitute a part of the App and Service Site, and also subject to this Terms of Use.
3.3 Changes to this Terms of Use
3.3.1 You agree that the Company reserves the right to change, modify, update, alter, or amend this Terms of Use at any time. The Company will however publish such changes to this Terms of Use anytime it formulates new ones, and bring same to the notice of all users in-app or by any other means as much as is technically possible.
3.3.2 You take responsibility for failure to examine the updated Terms of Use and re-accept same, and your continued use of the App after the amendment or modification of the Terms of Use indicate your acceptance of them.
3.4 Duration and Termination
3.4.1 This Terms of Use shall be in force as long as Bridgecard continues to offer the Services and you continue to use the App and Service Site. You agree that Bridgecard, as may be necessary and in its sole discretion, may terminate, revoke or suspend this Terms of Use.
3.4.2 In the event that you fail to comply with any provisions of this Terms of Use, Bridgecard will deem your non-compliance as an act of repudiation of this Terms of Use, and shall, accordingly, deem it terminated with respect to you. Uninstalling or deleting the App is also an act of termination.
3.4.3 You agree that your termination of this Terms of Use does not extinguish or limit any accrued rights that Bridgecard may exercise against you, and it does not also deny any remedies, in law or in equity, that Bridgecard may have against you.

4. Copyright Infringement
In any event where a copyright owner or such owner’s agent believes that any material on Bridgecard or Service Site constitutes an infringement of its/his/her copyright, the copyright owner or the copyright owner’s agent may issue us a copyright infringement notice, and such notice shall contain the following: (a) identification of the material that is claimed to be infringing; (b) your contact information, including your address, telephone number, and an email; (c) a statement by you that you have a good faith belief that use of the material is not authorized by the copyright owners; and (d) a statement that the information in the notification is accurate, and, under penalty of perjury you are authorized to act on behalf of the owner; and (e) a physical or electronic signature of the copyright owner or a person authorized to act on his behalf.

5. Indemnification
Every user agrees to indemnify Bridgecard or any of its affiliates against any claim or demand, including but not limited to attorney fees, cost of action, arising from your improper use of the App, violation of this Terms of Use, or any applicable law or regulation, and violation of the right of a third party.

6. Exclusion of Warranties and Limitation of Liability
6.1 Warranties
6.1.1 The App or Service Site is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Bridgecard, on its own behalf and on behalf of its affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.
6.1.2 Without limitation to the foregoing, Bridgecard provides no warranty or undertaking, and makes no representation of any kind that the App or the Service Site will meet your requirements, achieve any intended results, be compatible or work with any other software, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
6.1.3 If our assets are acquired by a third party, in which case Without limiting the foregoing, neither Bridgecard nor any Bridgecard 's network provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the App, or the information, content, and materials or products included thereon; (ii) that the App or Service Site will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the App or Service Site; or (iv) that the App, its servers, the content, or e-mails sent from or on behalf of Bridgecard are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
6.2 Limitation of Liability
6.2.1 Notwithstanding any damages that you might incur, the entire liability of Bridgecard and any of its agents under any provision of this Terms of Use and your exclusive remedy for all of the foregoing shall be limited to an amount which Bridgecard charges for your use of the App, or would have charged for same.
6.2.2 To the maximum extent permitted by applicable law, in no event shall Bridgecard or its agents be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the App or Service Site, third-party software and/or third-party hardware used with the App or Service Site, or otherwise in connection with any provision of this Terms of Use), even if Bridgecard or any supplier has been advised of the possibility of such damages.

7. Severability
7.1 If any provision of this Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under the relevant data protection and data privacy law and the remaining provisions will continue in full force and effect.
7.2 Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute waiver of any subsequent breach. A failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Terms of Use preclude further exercise of that or any other right granted herein.

8. Use of Our Services by Children
Our Services are not directed to individuals under the age of eighteen (18), and we do not knowingly collect personal data from individuals under eighteen (18).

9. Governing Law
The provisions of this Terms of use are governed by the laws of the Federal Republic of Nigeria.
